Terms and conditions

1. Provider and scope
These terms apply to the use of EO Funding Finder (the "service"), operated by David Pogorzelski, Geisbergstraße 18, 10777 Berlin ("we"). By creating an account or using the service you accept them.
2. The service
For a project description you enter, the service researches open calls, funding programmes and tenders in the field of Earth observation. It searches and evaluates curated sources and the open web. The result is a report with matches, deadlines, budgets and source references.
What the service expressly is not: the results are research support, not legal, tax or funding advice. The research is carried out by a language model and may miss calls, state deadlines or eligibility requirements incorrectly, or contain outdated information. What we owe is research carried out with care, not completeness and not correctness of the results. Always verify deadlines and eligibility on the official page of the programme in question before basing decisions on them.
3. Account
Use requires an account. You provide accurate details and keep your credentials secret. You are responsible for activity under your account. Contact support@dpogoda.dev if you suspect unauthorised use.
4. Credits and payment
The service is paid for in advance. One research run costs one credit; you buy credits in packs at the prices stated at the time. We may change prices and credit consumption for future use with reasonable notice; credits already bought keep their value.
Purchases are handled by Paddle as merchant of record. Your contracting party for the purchase is Paddle; its checkout terms apply to the purchase itself. Refunds are described in our withdrawal and refund policy. Statutory consumer rights are unaffected.
If a run fails, we return the credit automatically. That also applies when a run gets technically stuck and is therefore aborted. A run that delivers a result counts as performed, even if the result contains few or no matching calls. Whether suitable funding exists is the subject of the research, not something we promise.
Purchased credits do not expire. They are not transferable and are not paid out in cash. Credits granted free of charge have no monetary value; we may limit or withdraw them in case of abuse.
5. Acceptable use
You undertake not to:
- enter content that is unlawful or infringes third-party rights, in particular copyright, confidentiality and personality rights;
- enter personal data of third parties without a legal basis for doing so (see privacy policy);
- abuse the service, in particular by circumventing usage metering or usage limits, or by creating accounts under a false identity;
- resell the service as such, or access it automatically in a way that goes beyond normal use.
In case of serious or repeated breaches we may restrict or block access, after prior warning where that is reasonable.
6. Your content
You retain all rights in the texts you enter and in the reports generated for you. You grant us the rights needed to provide the service. We do not use your input to improve the service for other customers, and we do not release it for training language models.
7. Availability
We provide the service with reasonable care, but without guaranteed availability. Maintenance, capacity limits at upstream providers and circumstances outside our control can cause temporary outages. A run that fails as a result is refunded (section 4).
8. Liability
We are liable without limitation for intent and gross negligence, for damage arising from injury to life, body or health, and under mandatory statutory liability rules such as the German Product Liability Act.
For simple negligence we are liable only for breach of material contractual duties (duties whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely) and in that case limited to the foreseeable damage typical of this kind of contract. Any further liability is excluded.
In particular, we are not liable for disadvantages arising from a call not being found, a deadline being stated incorrectly in the report, or an eligibility requirement being assessed wrongly. Only the information published by the respective funder is authoritative.
9. Term and termination
You can stop using the service at any time and delete your account. We may terminate the contract with reasonable notice; in that case we refund the monetary value of unused, purchased credits. The right to terminate for cause is unaffected; on termination for cause, credits granted free of charge lapse.
10. Changes to these terms
We may change these terms for the future by email with at least 30 days' notice. If you do not object before they take effect, the amended terms apply to further use; we point this out in the notice. In case of material changes to your disadvantage you may terminate without notice.
11. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the EU, the mandatory consumer protection provisions of your country of residence are unaffected. If you are a merchant, the place of jurisdiction is Berlin.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
